Terms and Conditions

Welcome to MushBerrySpot. These Terms explain the rules for the Android app, the browser or installed PWA version (including on iPhone), and the public website. By creating an account, opening the service, publishing a spot, using the guide, checking a forecast, or accessing the website, you agree to these Terms. If you do not agree, do not use MushBerrySpot.

Our Privacy Policy is part of these Terms and explains how we process data. For questions, contact us at mushberryspot.app@outlook.com.

1. The Service

MushBerrySpot is a community map and informational tool for people interested in mushrooms, berries, and forest walks. The app lets users save and view spots, add photos, browse a guide, check approximate mushroom-weather conditions, open navigation, report incorrect content, and use partner links.

The service is provided for personal, recreational, educational, and informational use. It is not professional mycological, botanical, toxicological, medical, legal, or navigation advice.

2. Accounts

You may need an account to use core app features. You agree to provide accurate account information and to keep your login credentials secure. You are responsible for activity that happens through your account.

You may sign in with email or Google, depending on available app options. Third-party sign-in providers operate under their own terms and policies.

3. Age and Responsibility

MushBerrySpot is not intended for children under 13. If you are under the age required to enter into a binding agreement in your country, you may use the app only with appropriate permission and supervision from a parent or legal guardian.

You are responsible for your own decisions in nature, including where you go, what you collect, whether you enter private or restricted land, and whether any mushroom or berry is safe.

4. Free Use, Ads, and Purchases

MushBerrySpot may be used for free and may show advertising. Android may offer a one-time Google Play purchase that removes Android ads. The PWA does not currently show web ads or offer web checkout; if introduced, the provider, price, entitlement scope, consent options, and applicable terms will be shown before use or purchase. We do not currently offer subscriptions.

Android payments are handled by Google Play. A future web purchase would be handled by the payment processor identified at checkout. We do not store full card details. The relevant provider's payment and refund rules apply. Unless explicitly stated otherwise, an Android and a web remove-ads purchase are platform-specific and do not automatically unlock the other platform.

Features, prices, availability, and advertising formats may change over time. We will not intentionally remove a valid paid entitlement without a technical, legal, policy, fraud, refund, or platform reason.

5. User Content

User Content includes spots, coordinates, photos, descriptions, selected species, profile names, avatars, reports, and other information you submit. You are responsible for your User Content and must have the right to publish it.

By submitting User Content, you give us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt for technical formatting, moderate, remove, and distribute that content as needed to operate, promote, protect, and improve MushBerrySpot. You keep ownership of content you own.

Public spots are visible to other users. Do not publish a location, photo, person, private property detail, or sensitive information if you do not want others to see it.

7. Moderation and Enforcement

We may review, hide, delete, restrict, or refuse content or accounts if we believe they violate these Terms, create safety risk, infringe rights, harm the community, or create legal or platform-policy problems. We may act with or without prior notice.

Users can report suspicious or inappropriate spots. Moderation decisions may not be immediate or perfect, and the presence of content in the app does not mean we verified or endorse it.

8. Guide, Forecast, and Outdoor Safety

MushBerrySpot may include guide information, partner source links, user spots, photos, map markers, and mushroom-weather estimates. These materials can be incomplete, outdated, inaccurate, or unsuitable for your location.

Warning: mushroom and berry mistakes can cause serious illness or death. Never eat or handle a wild mushroom or berry based only on MushBerrySpot, a user spot, a photo, a guide card, or a weather estimate. Always verify with multiple authoritative sources and, when in doubt, consult a qualified local expert. If poisoning or exposure is suspected, seek immediate medical help or contact local poison control.

You assume all risks connected with forest trips, including poisoning, allergic reactions, terrain, weather, wildlife, ticks, navigation errors, poor mobile coverage, trespass rules, harvesting limits, and protected-species restrictions.

9. Our Content and Intellectual Property

The app, website, design, code, logos, brand assets, texts, compiled guide structure, and other non-user materials belong to us or our licensors and partners. You may use them only as allowed by these Terms and applicable law.

NAGRZYBY.PL and other partner names, links, photos, materials, and trademarks remain the property of their respective owners. Source links and credits do not transfer any rights to you.

10. Third-Party Services and Links

MushBerrySpot uses or links to Firebase, Google Maps, Google Play, Google AdMob, Cloudflare, Visual Crossing, Facebook, Instagram, NAGRZYBY.PL, and other partner resources. Google AdSense, a certified consent platform, and a named web payment processor may be added when web monetization is activated. These services are controlled by third parties and may have their own terms, policies, availability, pricing, and technical limits.

We are not responsible for third-party services, outages, map errors, weather-provider errors, external content, social media groups, partner websites, or decisions made outside MushBerrySpot.

11. Copyright and Rights Complaints

If you believe content in MushBerrySpot infringes your copyright, privacy, image rights, trademark, or other rights, contact us at mushberryspot.app@outlook.com. Include enough information to identify the content, explain the issue, and verify that you are the owner or authorized representative.

We may remove or restrict content while reviewing a complaint. False or abusive complaints may be rejected.

12. Availability, Changes, and Updates

We may update, change, suspend, or discontinue any part of MushBerrySpot. Some features depend on network access, device or browser permissions, Firebase, maps, ads, billing, Cloudflare, Visual Crossing, and other systems outside our control.

You are responsible for installing Android updates or refreshing/reinstalling the PWA when needed for security, compatibility, and continued operation. A service worker and browser cache may temporarily keep an older web version until it updates.

13. No Warranties

To the maximum extent permitted by law, MushBerrySpot is provided "as is" and "as available". We do not guarantee that the app will be uninterrupted, error-free, accurate, safe, complete, suitable for your purpose, or available in every location or on every device.

We do not guarantee the accuracy of user spots, species names, guide information, photos, forecasts, maps, navigation links, advertising, partner links, or third-party content.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost profits, personal injury, poisoning, property damage, trespass consequences, or decisions made based on app content.

Nothing in these Terms limits rights that cannot legally be limited, including mandatory consumer rights or liability that cannot be excluded under applicable law.

15. Indemnity

If your content, actions, or misuse of MushBerrySpot causes claims, losses, or expenses against us, you agree to cooperate and, where legally allowed, compensate us for reasonable losses connected with that issue.

16. Termination

You may stop using the app at any time and may request account deletion. We may suspend or terminate access if you violate these Terms, create safety risks, abuse the service, infringe rights, or create legal or platform-policy problems.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of MushBerrySpot after changes means you accept the updated Terms.
